Terms of Service

capVerse Terms & Conditions

Effective date: November 15, 2024. Please review these terms carefully—they form a binding agreement between you and capVerse whenever you upload content or render clips with our tools.

1. Acceptance of terms

These Terms of Service (“Terms”) govern your access to and use of the capVerse platform, including the dashboard, editor bench, render pipeline, and APIs (collectively, the “Service”). By creating an account, uploading media, or using any feature, you agree to be bound by these Terms and our Privacy Policy.

2. Eligibility & accounts

You must be at least 13 years old (or the age of digital consent in your jurisdiction). If you register on behalf of a company, you represent that you have authority to bind that entity.

You are responsible for safeguarding your login credentials and for all activity under your account. Notify us immediately at support@capverse.com if you suspect unauthorized access.

3. Permitted use

You may use capVerse to upload content you have the right to process, generate clips, download renders, and manage assets for your own creative or business projects.

Prohibited uses include: infringing or unlawful content, harassment, attempts to reverse engineer or overload the Service, automated scraping of generated assets, or reselling the Service without a separate reseller agreement.

4. Content ownership

You retain all ownership of videos, audio, captions, and other assets you upload. By using capVerse you grant us a worldwide, non-exclusive license to process that content solely to deliver the Service (e.g., transcribe, render, host, and stream previews).

We may collect de-identified usage statistics to improve accuracy, render performance, and product reliability.

5. Subscription & payment

Some features require a paid plan. Fees are billed through our payment processor and renew automatically until canceled.

You may cancel at any time; access to premium features continues through the end of the billing period. Refund requests are handled on a case-by-case basis where mandated by law.

6. Service availability

We strive for high uptime but do not guarantee uninterrupted access. Maintenance windows, network outages, or third-party downtime may impact availability. We may modify or discontinue features with reasonable notice.

7. Warranties & disclaimers

The Service is provided “as is”. We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee specific engagement results or platform approvals for your clips.

8. Limitation of liability

To the fullest extent permitted by law, capVerse and its team will not be liable for indirect, incidental, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim will not exceed the amount you paid for the Service in the 3 months preceding the event giving rise to the claim.

9. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or applicable laws. Upon termination we will delete or anonymize associated data in line with our Privacy Policy.

10. Governing law & disputes

These Terms are governed by the laws of Poland, without regard to conflict-of-law principles. Any disputes will be resolved in the competent courts of Warsaw, unless a different jurisdiction is required by local consumer law.

11. Changes

We may update these Terms from time to time. We will notify you via email or dashboard banner when material changes are made. Continued use after the effective date of an update constitutes acceptance of the revised Terms.
